SECTION 52 OF THE TOWN COUNCILS ACT ENOUGH TO PROTECT WP COUNCILLORS OF ALL FAULT?

The only claims against Pritam Singh, Kenneth Foo and Chua Zhi Hon are in respect of the appointment of LST Architects without due tender. This was said to be a breach of the duties of care and skill (qua fiduciary) and/or duty of care and skill in tort.

I saw no allegation of bad faith against them in the SoC. Why wouldn't Section 52 of the Town Councils Act be a complete defence?

Section 52 reads:

"Protection from personal liability

52. No suit or other legal proceedings shall lie personally against any member, officer or employee of a Town Council or other person acting under the direction of a Town Council for anything which is in good faith done or intended to be done in the execution or purported execution of this Act or any other Act."
