The only claims against Pritam Singh, Kenneth Foo and Chua Zhi Hon are in respect of the appointment of LST Architects without due tender. This was said to be a breach of the duties of care and skill (qua fiduciary) and/or duty of care and skill in tort.
I saw no allegation of bad faith against them in the SoC. Why wouldn’t Section 52 of the Town Councils Act be a complete defence?
Section 52 reads:
“Protection from personal liability
52. No suit or other legal proceedings shall lie personally against any member, officer or employee of a Town Council or other person acting under the direction of a Town Council for anything which is in good faith done or intended to be done in the execution or purported execution of this Act or any other Act.”
